Entre los hechos y los actos

-En ocasiones hablas de un acto y en otras de un hecho. Por el énfasis que das a cada uno puedo deducir que para ti es importante marcar la diferencia, podrías aclararlo para mí-

-Por supuesto. Un acto es el resultado de la acción de un sujeto. Lo que implica que tiene voluntad de realizar el acto o acción, como quieras llamarlo. En cambio un hecho es algo que pasa sin que haya un actor de por medio-

-Deja lo ejemplifico para ti.Supón que llueve y caen algunos rayos que a su vez incendian una choza abandonada, pero por estar lloviendo, no la queman del todo, queda, por así decirlo, medio quemada. En este caso estamos hablando de hechos, pues no hubo nadie que quiso primeramente quemarla con un rayo y luego apagarla con la misma lluvia. Más aún no hubo nadie que planeara el resultado.-

-En cambio, imagina que un sujeto decide prenderle fuego a otra choza igualmente abandonada en un lugar solitario, pero mientras la ve quemándose decide apagarla. En este caso estamos hablando de actos, pues hay una voluntad detrás de todo eso, primero de prenderla y luego de apagarla-

-Ambos acontecimientos tienen resultados que afectan a las personas y su ambiente, pero mientras en la segunda hay un actor responsable en la otra se trata de hechos de la naturaleza, no hay un responsable del hecho, aunque puede haber un responsable de las consecuencias, como por ejemplo, cuando hay un seguro-

-Me queda claro, pero imagina que en el primer caso hubo una voluntad superior, digamos Dios, que por alguna razón tuvo resultados benéficos para alguien-

-En general los hechos de la naturaleza los llamamos fuerza mayor, al no haber hegemonía en la explicación de un ser superior, pero siguen siendo hechos-

-Ok, pero que tal en el segundo caso cuando el actor es forzado, aquí no hay voluntad-

-En ese caso ya entramos en otro tema mucho más extenso. Solo piensa esto. Si con ejemplos tan simples aún hay mucho que aclarar imagina como será en las cosas complejas de la vida. Si quieres el tema de la voluntad lo dejamos para otra ocasión. Te parece?-
