Well, To Be Sure Let's Go To The Location (Field Experience)

Ok, this time I will tell you a little about my experience in handling cases in court. But I'm only telling you about my experience, I am allowed to tell you about the essence of material cases. Well, this case is still in process and there has been no court decision. Yes, this time we conducted field checks on several disputed objects. In courts in Indonesia, civil cases, especially property cases, must be examined and checked in the field.

Why this is needed? because in essence, the field inspection aims to see the suitability of the property being sued with the facts on the ground. It could be someone who is suing and being sued for assets that do not belong to him and even if later there is a court decision, then what is decided is real and can be executed. We investigated 12 objects, including oil palm plantation land, coconut plantation land, rice fields, houses, cars, and motorbikes.

This field inspection is carried out in cases related to movable or immovable property disputes and aims to increase the judge's confidence in the clarity of the object of the case before giving a decision and the examination is carried out at the place where the object being disputed is located and all processes are recorded in a document. Usually, we call it the Minutes of Descente or in Bahasa is Berita Acara Pemeriksaan Setempat.

We started this field inspection by opening a trial at the local Village Hall, then together with all the disputing parties went to the object that I have mentioned above and we were accompanied by the Land Officer who aims to ensure that the object seen has been recorded in official state documents actually. Btw, we were also accompanied by the local Police to maintain security and comfort during the inspection.

The investigation that we carried out was really tiring, considering the extent of the object of the dispute and being in several villages far from one another. However, considering that this is a task, we strive to complete the examination quickly, clearly, and thoroughly. Luckily, we were able to finish it before 4 PM.

Some of the obstacles we faced in the field that day were some objects that we couldn't find on the spot. This is reasonable and is a conclusion for the examiner. Because some livestock such as cows and buffalo were released in the morning to look for grass and we couldn't find it one by one.

Some of the things that became my focus during this field examination were the cooperative attitude of the Plaintiff and Defendant in this case in showing the location and property of the disputed property so as to make this examination run smoothly without significant obstacles. One more thing, the attitude of good cooperation between agencies. Although the Court, the Land Agency, and the Police are different institutions, in terms of providing legal certainty to the community, these three institutions are very compact.

Yes, this is one of the tasks of the courts in Indonesia in resolving civil disputes, although it looks tiring, but this must be carried out. The position of the examination in the field is very important so that later there will be no illusory court decisions or cannot be carried out because of the unclear object of the case.

I don't really understand the process of civil cases in other countries, but I think the legal system in Indonesia and other countries is different, so it is possible the field investigations don't exist in other countries, but there are in other countries.
